These Terms & Conditions apply to purchases made from Stirling Cycles, including purchases made in our shop, by telephone, email and through our website.

Stirling Cycles is operated byStirling Cycles SC3134880, VAT number135 4491 15.

By placing an order with us, you agree to these Terms & Conditions.

1. About Us

Stirling Cycles is an independent bicycle retailer and workshop.

2. Products and Pricing

We make every effort to ensure that product descriptions, specifications, photographs and prices shown on our website and in-store are accurate.

Manufacturers may change specifications, colours, components or equipment without notice. Where this happens, we will make reasonable efforts to inform the customer where the change materially affects the product ordered.

Prices may change at any time. The price applicable to your order is the price agreed at the time the order is placed.

We reserve the right to correct obvious pricing or product description errors. If an obvious error affects an order, we will contact the customer before proceeding.

3. Bike Orders and Special Orders

Some bicycles are ordered specifically for an individual customer rather than being taken from our general shop stock.

A special-order bike may include:

• A particular frame size requested by the customer
• A particular colour or specification
• A model ordered specifically from the manufacturer or distributor
• A bike ordered specifically because of a customer's requested requirements
• A bike that is not normally held in our shop stock

Where a bike is ordered specifically for a customer, we may require a deposit or payment before placing the order with the manufacturer or distributor.

The customer will be informed of the agreed price and any deposit required before the order is placed.

4. Bike Sizing

We are happy to provide reasonable guidance and advice regarding bike sizing.

Where possible, we may use the customer's height, measurements, previous bike, riding requirements and other information to recommend a suitable size.

However, sizing recommendations are provided as guidance and are not a guarantee that a particular frame size will be suitable for every rider.

The final decision to purchase a particular frame size remains with the customer.

Where a customer has specifically requested a particular frame size after receiving our advice, the customer accepts responsibility for confirming that the chosen size is suitable for their requirements.

Where appropriate, customers are encouraged to visit the shop and try a suitable bike or discuss sizing with a member of our team before placing an order.

5. Bike Assembly and Preparation

New bicycles supplied by Stirling Cycles may arrive from the manufacturer or distributor in a partially assembled or boxed condition.

Before collection, our workshop will assemble and prepare the bicycle as reasonably required for safe use.

This may include:

• Assembly of the bicycle
• Adjustment of gears and brakes
• Checking bolts and components
• Setting tyre pressures
• Checking wheels and bearings
• Setting the handlebars, saddle and controls
• Carrying out a safety and pre-delivery inspection
• Adjusting the bike to the customer's agreed setup where applicable

As an independent bike shop, we may build a bicycle specifically for the customer rather than holding every size and specification as finished shop stock.

6. Discounted Bikes

Discounted prices may be offered on current models, previous-year models, ex-display bikes, clearance stock, promotional bikes or bikes ordered specifically for a customer.

A discounted price does not remove or reduce the customer's statutory rights.

Unless specifically stated otherwise, discounted bikes are supplied with the same statutory consumer protections as bikes sold at the normal price.

Where a discounted bike is specifically ordered for a customer, the customer will be informed of this before the order is placed.

A discount may be offered because the bike is a special-order, clearance, previous-model-year, promotional or otherwise reduced-price item.

Any existing damage, cosmetic marks, missing accessories or other known issues relating to an ex-display or clearance bike will be explained to the customer before purchase.

7. Deposits and Payments

Where a deposit is requested, the amount will be agreed with the customer before the order is placed.

A deposit may be used towards the final purchase price.

Where a customer cancels an order, any amount retained by Stirling Cycles will be limited to amounts we are legally entitled to retain, including reasonable losses or costs directly resulting from the cancellation where applicable.

We will not automatically retain a deposit simply because it is described as "non-refundable". Any cancellation charge or retained amount must be fair and reasonable.

Where a manufacturer or distributor has supplied a product specifically for a customer and the customer subsequently cancels, we may take into account any genuine costs or losses incurred as a result.

8. Cancellation of Orders

Cancellation rights depend on how the purchase was made and the circumstances of the order.

Purchases made in our shop may have different cancellation rights from purchases made online, by telephone or by other distance-selling methods.

Where statutory cancellation rights apply, these will not be excluded by these Terms & Conditions.

Certain goods made to a customer's specifications or clearly personalised may be excluded from statutory cancellation rights.

However, simply ordering and assembling a standard bicycle does not automatically make the bicycle a bespoke or personalised product.

Where a customer cancels an order, we will consider the circumstances of the order and the customer's legal rights before determining whether any refund, deduction or cancellation charge applies.

9. Distance and Online Sales

For purchases made online, by telephone or by another method covered by the Consumer Contracts Regulations, the customer may have statutory cancellation rights.

Where applicable, customers will normally have 14 days from receiving the goods to notify us that they wish to cancel, followed by the applicable period to return the goods.

Exceptions can apply, including certain goods made to the customer's specifications or clearly personalised.

Where statutory cancellation rights apply, we will provide the customer with the information required by law.

10. Returns

Our returns policy applies alongside these Terms & Conditions.

Customers should contact us before returning an item wherever possible.

Goods returned because the customer has changed their mind may be subject to the applicable statutory cancellation rules and any reasonable return arrangements explained to the customer.

Goods should be returned in an appropriate condition and with the original accessories, documentation and packaging where reasonably possible.

This does not affect the customer's statutory rights in relation to faulty or misdescribed goods.

11. Faulty or Defective Goods

Customers have statutory rights where goods are faulty, not as described, not of satisfactory quality or not fit for their intended purpose.

These rights apply whether the bicycle or component was sold at full price or at a discounted price.

Where a fault is reported, we may need to inspect or assess the bicycle before determining the appropriate remedy.

Depending on the circumstances, the appropriate remedy may include repair, replacement, price reduction or refund in accordance with applicable consumer law.

We may work with the bicycle manufacturer or distributor where a manufacturer warranty or technical investigation is required.

The existence of a manufacturer warranty does not remove the customer's statutory rights against Stirling Cycles.

12. Manufacturer Warranties

Where a manufacturer provides a warranty, the warranty is subject to the manufacturer's own terms and conditions.

We will assist customers with reasonable warranty claims where appropriate.

A manufacturer's warranty does not replace or limit the customer's statutory rights against Stirling Cycles.

13. Workshop Services

Workshop services will be carried out with reasonable care and skill.

Before carrying out chargeable work, we will provide an estimate or quotation where reasonably possible.

Additional faults or work may be identified during a repair.

Where additional work is required, we will normally contact the customer before carrying out work that materially increases the agreed cost.

For safety reasons, we may recommend that certain components are replaced where they are worn, damaged or considered unsuitable for continued use.

14. Customer-Requested Components and Adjustments

Where a customer specifically requests a component, setup or adjustment that differs from the manufacturer's standard specification, we will discuss the request with the customer.

We may advise the customer if we believe a requested change is unsuitable, unsafe or incompatible.

Where a customer chooses to proceed against our recommendation, we may decline to carry out the work where we believe doing so would create a safety risk.

15. Collection of Bicycles

Customers will be contacted when their bicycle is ready for collection.

The bicycle should be collected within a reasonable period.

Where a bicycle remains uncollected for an extended period, we may contact the customer to arrange collection.

The bicycle will remain the customer's responsibility once it has been accepted and collected, subject to the customer's statutory rights.

16. Bicycle Insurance

Stirling Cycles may provide information about bicycle insurance or direct customers to an insurance provider where appropriate.

Any insurance policy is a separate agreement between the customer and the insurance provider.Stirling Cycles is not the insurance provider and is not responsible for providing, arranging, maintaining or paying for the customer's insurance policy unless expressly agreed otherwise in writing.

It is the customer's responsibility to:

• Decide whether they wish to insure their bicycle.
• Arrange and purchase any insurance policy directly with the insurance provider.
• Check that the policy provides suitable cover for their bicycle and circumstances.
• Read and understand the terms, conditions, exclusions and requirements of the insurance policy.
• Keep the insurance policy active and up to date where required.

Stirling Cycles is not responsible for reminding customers to purchase, renew or maintain bicycle insurance.

If a customer chooses not to take out insurance, this does not affect their obligation to pay for the bicycle or any other goods or services purchased from Stirling Cycles.

Any information provided by Stirling Cycles about insurance is for general information only and should not be considered insurance advice or a recommendation that a particular policy is suitable for the customer.

The customer's insurance agreement is solely with the relevant insurance provider, and any questions, claims or disputes regarding the insurance policy should be directed to that provider.

17. Product Availability and Delivery

Estimated delivery dates provided by manufacturers or distributors are estimates only.

We will make reasonable efforts to keep customers informed of significant delays.

Manufacturer or distributor delays outside our reasonable control will not automatically entitle the customer to compensation.

Where the law provides a specific delivery right or remedy, that right will continue to apply.

18. Changes to Manufacturer Specifications

Bicycle manufacturers may change specifications, components, colours or equipment during a model year.

Where a manufacturer makes a minor specification change that does not materially alter the bicycle, we may supply the updated specification.

Where a change materially affects the product ordered, we will contact the customer where reasonably possible.

19. Safety

Customers are responsible for using bicycles and cycling equipment safely and in accordance with the manufacturer's instructions.

We recommend that customers have any bicycle purchased from another source inspected by a qualified bicycle mechanic before use where appropriate.

Customers should regularly check brakes, tyres, wheels, steering, drivetrain components and other safety-critical parts.

Any safety concerns should be reported to us immediately.

20. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory rights that consumers have in relation to goods or services.

We are not responsible for losses that are not reasonably foreseeable or which are outside the scope of our agreement with the customer, except where the law requires otherwise.

21. Personal Information

Personal information provided to Stirling Cycles will be handled in accordance with our Privacy Policy.

We will use customer information where necessary to process orders, arrange deliveries, provide workshop services, contact customers regarding their purchases and meet our legal obligations.

22. Complaints

If you are unhappy with a product or service, please contact us as soon as possible.

We will aim to investigate complaints fairly and resolve issues where possible.

23. Governing Law

These Terms & Conditions are governed by the laws of Scotland.

Any disputes will be subject to the applicable courts of Scotland, subject to any mandatory consumer rights that apply.

24. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to an order will generally be the version in effect when the order is placed, unless changes are required by law.

25. Statutory Rights

Nothing in these Terms & Conditions is intended to remove, restrict or reduce any statutory rights available to consumers under UK law.

Where these Terms & Conditions conflict with mandatory consumer protection law, the applicable law will take precedence.
